  1. What is a Legal Presence? I have my two grandchildren living with me. They have been with me and my husband ever since their mom, dad is deceased, went into a series of jail and prison and secure living facilities. The grandson will be 18 in august, and the granddaughter will be 17 in October. I do not have custody, that isn’t one of the listed necessities for getting the state ID. The mom is released but the grandchildren does not want to be in her presence. I have all the necessary documents to get them their state ID, the grandson will need his to open a bank account when he turns 18.

    1. For most kids applying for a standard Ohio ID, the child’s own certified U.S. birth certificate or U.S. passport is what covers legal presence — it does double duty as proof of identity/DOB and legal presence in one document.

Also required alongside it for a minor:

      • There’s no minimum age for an ID card, but the applicant still needs proof of legal name, date of birth, Social Security number, legal presence, and Ohio residency.
      • A parent or guardian must accompany anyone under 18, and that parent/guardian also has to present their own proof of name, date of birth, and Social Security number.
      • Two documents proving Ohio street address are typically needed as well (for the Compliant/REAL ID version).
